Unfair Dismissal and 'Lazy' Workers

Much comment has been made over the last few days regarding an alleged report from a venture capitalist that businesses should be given the right to sack unproductive workers.  ‘Workers coasting along’ and unfair dismissal laws have been suggested to have a significant detrimental impact on economic growth.  Perhaps the reality is that Governments will all invariably make noises regarding such issues and will swing like a pendulum, albeit with one set of protective measures being replaced by another if indeed they are removed. 

What employers should take into consideration is that businesses already have the power to dismiss underperforming employees.  Businesses should act swiftly, grab the bull by the horns and act at the right time, having taken the right advice.  As an employment lawyer, I am acutely aware that business owners are busy doing what they do best, running businesses, and find the burden of increasingly complicated employment law somewhat burdensome.  However it does not detract from my original point that poor performance and poor conduct can be managed.  In addition, both these issues tend to be present early if you look for and manage the signs.  If matters are dealt with properly the law, and indeed Employment Tribunal Judges, will more often than not be on your side.  You need to manage and appraise staff and act at the right time on the right advice.
