Residential Landlord and Tenant Specialists Possession and Rent Arrears

We offer a fixed fee service for Possession and Rent Arrears claims arising out of Assured Shorthold Tenancies.

There are two options in commencing Court proceedings to obtain a Possession Order.

Accelerated Possession Proceedings

Accelerated Possession Proceedings can only be used where:-

  • The Tenancy is an Assured Shorthold Tenancy
  • There is a written Tenancy Agreement
  • A valid Section 21 Notice has been served on the tenant and has expired
  • You only want to claim possession (not rent arrears as well)
  • The deposit, if taken on or after 6 April 2007, has been registered in a Tenancy Deposit Scheme


The advantage of the Accelerated Possession procedure is that, provided the paperwork is all correct, the Court has the power to make an Order for Possession without requiring a Hearing, therefore saving time and legal fees.  If successful, a Landlord will obtain:-

1. An Order for Possession usually within fourteen days.
2. An Order that your tenant pays your costs.

Normal Possession Proceedings

This can be used where:-

  • A valid Section 8 Notice has been served on the tenant and has expired
  • There is no written Tenancy Agreement
  • You wish to recover rent arrears as well as possession
  • You are seeking possession on the basis of breach of some other terms of the Tenancy Agreement


If successful, the Landlord will obtain:-

1. An Order for Possession usually within fourteen days (although sometimes suspended).
2. A money Judgment for the rent arrears due at the date of the Court Hearing
3. An order that the tenant pay an occupation rent calculated on a daily basis until the tenant vacates the property.
4. An Order that the tenant pays your costs.

Court Issue Fee - £175
Court Bailiff’s Fee - £110
