Solicitor Publishes first property book

 

 Associate, Andrew Lugger of Stones Solicitors has had his first book published by Northumbria Law Press, ‘The Law of Restrictive Covenants: A Developer's Curse'.

The Book, part of a series of books published under the ‘Property Solutions Series' is aimed at property professionals who need to get up to speed quickly on a particular topic in property law and practice.

Andrew, is part of Stones Commercial Property Team, and also heads up the Firms Okehampton Office and Agriculture department. The book covers the complex rules relating to the enforceability and interpretation of covenants, examines whether there is a requirement on the part of the covenantee to act ‘reasonably' when giving or withholding consent and, in relation to breaches of covenant, considers when damages may be awarded instead of an injunction. In addition it looks at strategies for overcoming restrictive covenants, whether through an application to the Lands Tribunal under section 84 of the Law of Property Act 1925 or through the use by a local authority of its planning powers.

The guide is concise enough for the relevant principles to be quickly assimilated but detailed enough to be of use as a reference text. As well as being relevant to those working in the property industry it would also be useful to students and those seeking a professional qualification in this area.

Andrew who is currently completing his Ph.D hopes to be able to publish some further works, based on the Lands Tribunal and Legal History under Queen Victoria. He has also written articles on Planning and Licensing Law
