Samantha is a Partner in the Travel Tourism & Insurance Team.
Samantha specialises in travel accidents, including skiing matters, mainly assisting in relation to Claimants injured abroad. She also deals with subrogated recoveries for Insurers and advising Insurers in respect of Personal Accident Claims and Insurance Claims relating to Permanent and Total Disability.
Samantha’s memberships include the Association of Personal Injury Lawyers, the Institute of Travel and Tourism, and the Travel and Tourism Lawyers Association.
Samantha has recently advised in relation to:
- Road Traffic Accidents involving UK residents whilst on holiday in Australia, including one where the Claimant sustained significant injuries necessitating Court proceedings. Samantha dealt with the Compulsory Conference by way of video link with all relevant parties in Australia resulting in an out of Court settlement in excess of AU$1 million
- A night time skiing accident in Canada where the Claimant sustained injuries when participating in an excursion. Amongst the various Defences raised, the issue of Waivers and the effect of the same had to be dealt with. Proceedings were issued in Canada although the claim was settled prior to the Final Hearing which included recovery for the Claimant and also subrogated recoveries for the Travel and Private Health insurers and the Claimant’s former employers
- Jurisdictional issues relating to a road traffic accident involving both personal and fatal injuries which are the subject of ongoing Greek proceedings. Appeals were made following the First Instance Court Judgment and advice requested to be presented to the Greek Court of Appeal
- A Claimant who sustained personal injuries in a slipping accident in a Hotel in Zante, Greece. The claim was fully contested and dealt with (successfully on the Claimant’s behalf) by split Trial in the UK involving local expert evidence. Thereafter the claim was valued and settled shortly before the Damages hearing.
