Claire has recently advised in relation to:
- A financial dispute between Husband and Wife which took into account the Respondent’s serious conduct (resulting in the Respondent’s imprisonment) and substantial inheritance received by the Applicant after the parties’ separated.
- A financial dispute where ex-Husband argued that he had resumed his relationship and co-habitation with his ex-Wife at her property for six years after divorce and had built an extension/made significant home improvements to her property in the belief that he would come onto the title deeds. Ex-Wife argued that post divorce he was merely a lodger and had no financial interest in her property.
- A case where an Indian Father alleged that Indian Mother would not return their child to the UK if she was allowed to go on holiday to India with the child. As the UK home had been sold and the parties were in negotiations regarding a fair division of the net proceeds of sale, the Father argued at Court that there should be a financial bond in place, representing the Mother’s share of the sale proceeds, to guarantee the return of the child to the UK. The Judge did not allow this and accepted the Mother’s Undertaking to return the child by a certain date.
