Andrew is an Associate in the Litigation and Dispute Resolution Team.
Andrew has 9 years experience in insolvency, acting for Insolvency Practitioners, Local Government bodies as well as individuals and business requiring insolvency advice.
Acting for Trustees in Bankruptcy as well as Liquidators Andrew deals with all types of asset recovery and antecedent transactions such as undervalue claims and wrongful trading.
Andrew also advises individuals on all matters of insolvency including defending claims by Trustees against the matrimonial home, the annulment of bankruptcy orders and applications to set aside statutory demands.
Andrew has recently advised in realtion to:
- A Trustee in applying for a Section 313 Insolvency Act 1986 charge over the bankrupt's home.
- Acting for Local Government bodies Andrew has advised on the recovery of rates and council tax from both individuals and businesses and the effects of insolvency proceedings on the prospects of such recovery.
- Advised businesses in respect of the validity of retention of title clauses, directors filing petitions to wind up their companies and on the removal of directors.
- Andrew was previously involved in the reported case of Re: Trident Fashions [2006] All ER 140 (liability of Administrators to pay non-domestic rates as an expense of the administration).
Andrew also acts in general litigation matters and has recently advised in relation to:
- Consumer Credit Act claims against lenders;
- Contractual disputes;
- Recovery of unpaid debts;
- Beneficial interests in property
